Be Awesome - Booking Terms & Conditions

Our terms and conditions are a contractual agreement made between Be Awesome, their Photographers, employers, independent contractors and holding companies (“The Company”) and You (the "Client").

On booking a Headshot session with Be Awesome you agree to our Terms & Conditions below.

This agreement contains the entire understanding between Be Awesome and the client. It supersedes all prior and simultaneous agreements between the parties. Any additions or changes to this agreement must be in writing and signed by all parties involved.

Any booking confirmed or booked with The Company means you agree to all Terms and Conditions for your participation and for any and all minor children's participation.

Any parent or guardian signing for a minor child agrees that they have permission to do so and that they are a legal guardian of said minors.

1. Headshot charges: All Photos, photographs, Headshots, images, packages/session or photoshoot charges are for the electronically transferred images, creation of digital images, and the right to reproduce/copy the digital images; all are released under personal promotion use only non-exclusive rights. Non-Commercial.

2. Retainer - Holding fee: The Company will charge a retainer as a holding fee to confirm your booking. This will be 50% of the total owed and is needed to secure your booking date. This is applied to your balance due on your session date. This fee is non-refundable but can be transferred to a future booking date if you reschedule with at least 24 hour’s notice.

3. Guardian/Parent: A Guardian or parent must be with the child at all times during the headshot session. Guardian/parent cannot drop off any child under the age of 18 and must be present during the entire session. Guardian/Parent is fully responsible for their child/children during the entire session.

4. Siblings/Friends: Any siblings or friends arriving without a confirmed booking must also be supervised at all times by a parent/guardian. Be Awesome will not be held liable for any damage or injury caused to the child/children when at the studio or when participating in a Be Awesome shoot whether on location or in the studio. The Company is not responsible or liable for unattended minors on or near the Be Awesome studio or surrounding area of an event or session on location. The client releases The Company from any and all liability regarding any injury or damage due to any minors being present during the session.

5. Rescheduling: If you need to reschedule your booking, we require at least 24 hour’s notice before the start of your session. Please email or call us to reschedule. Your retainer fee will be transferred over to your new booking date. Failure to reschedule that results in a no show will result in the holding fee being charged in full as a cancellation fee.

6. Cancellation: All cancellations made less than 24 hours before your shoot will result in the holding retainer fee being charged in full.

7. Late Arrivals: This will result in a reduced shoot time which means less images and less clothing changes/looks. We may have clients booked after you and we cannot go into their time. Arriving 15 minutes late will result in a cancellation and your holding fee will be charged in full.

8. Release: Client gives permission for The Company to use all images and variations of images from the session for Be Awesome brand Websites, social media, portfolios, galleries, or other promotional materials including but not limited to mailers, flyers, postcards, newsletters.

9. Copyright: The Company retains all copyright to all images from Clients session. All images are property, rights, copyrights and royalties of The Company.

10. Use of images: All images are released under personal promotion use only with non – exclusive rights. Images are Non-Commercial. Please contact us if you require commercial use for rates and contract. Images are for personal purposes only. Images cannot be used for anything that results in financial gain such as (but not limited to) advertising, stock photography, print sale or resale.

11. Failure to shoot: In the event of an extreme and unplanned incident outside of our control (including but not limited to floods, earthquakes, any natural disasters) then The Company will only be liable for the holding fee paid. We will not be liable for any additional costs due to loss of booking.

12. Delivery of images: The Company will provide a digital download link to your gallery within 7 days which will be available for you to download for 3 months after. After this the link will expire and images will be archived. To receive your images again, a $50 fee will be charged.

13. Loss of images: The Company is not liable to the Client for any loss of images or digital downloads.

14. Indemnification: The client holds The Company free from any and all liability due to injury or illness during the shoot. The client agrees not to hold The Company liable for any future injuries or damages. The client agrees that will indemnify and hold The Company harmless from any loss, liability, damage, cost or expense, including litigation, which may incur as a result of any injury and/or property damage which myself or minor children may sustain while participating in photography, headshots or related activities with The Company.

15. Client Risk: As a client, you assume any and all risks of injury, death or property damage and to release and hold harmless The Company, Be Awesome brand, its employers & agents.

15. Retouching: We do not recommend a lot of retouching for Kids Headshots, however, if you require retouching then Be Awesome will invoice for retouching at the fees of $30 per image.

16. Refunds & Re-shoot: The Company will only provide a refund or option of re-shoot due to any technical difficulties due to photographer or studio issues from their side.
We will not provide any refund or reshoot due to reasons such as clients clothing choice, un-cooperative kids or refusal to shoot. We appreciate kids can be unpredictable on the day and our photographer will make every effort to ensure the shoot goes well and to work with the child, however, we cannot make any guarantee that all shots will be captured.

17. Photographer Cancellation. If the Photographer is unable to fulfil the booking due to unforeseen circumstances, including but not limited to illness, injury, studio damage or any other emergency, then the Photographer reserves the right to reschedule the Session.
If rescheduling is not possible and the client prefers to cancel, then the Client will be entitled to a refund of the retainer fee paid and only this fee. The Client confirms that the Photographer's liability is limited to the refund of the retainer fee and agrees that no further compensation will be sought. The client releases the company from any and all other payment and compensation claims.

Be Awesome Staff and Photographers all hold Child Performer Service Permits.
